Can A Sexual Assault Compensation Calculator Help Me Estimate My Claim?

Yes, a sexual assault compensation calculator can offer an estimate based on the severity of your criminal injuries and the resulting financial losses. The part of your compensation, which evaluates your bodily and psychological harm, will be calculated using the Criminal Injuries Compensation Scheme 2012. What Sexual Assault Compensation Could I Receive?

Your sexual assault compensation will depend on the CICA tariff that aligns with your injuries and whether you have experienced multiple injuries. When calculating compensation for more than one injury from the main tariff, the following formula will apply:

  • You will be awarded 100% of the tariff for the injury with the highest value
  • 30% of the 2nd highest value injury will be given to you
  • 15% of the 3rd highest value will be included in the compensation

However, not all injuries are included in the main tariff and therefore are not subjected to the multiple injuries formula. These include if the incident resulted in a pregnancy or caused the loss of one, or you contracted a sexually transmitted infection.

Can Special Expenses Make Up Part Of Your Criminal Injuries Compensation?

Yes, special expenses, which allow you to recover the costs incurred due to injury, may be included in sexual abuse compensation. For example, you could add the following to your criminal injury claim:

  • The cost of replacing necessary physical aids, such as a pair of glasses, which were damaged during the incident
  • The expense of adapting your home to make it liveable for your condition (for example, you may get a stairlift installed)
  • Administration costs relating to the management of your affairs due to mental incapacity preventing you from doing such tasks yourself
  • Payments for equipment that is needed to help you live with the harm you have suffered (this could apply to a specially adapted car)
  • Professional care costs required to help with food preparation or bodily functions
  • Expenses made for supervision that aims to prevent you from posing a danger to others and yourself

Certain claimants may also be able to add lost earnings to their compensation claim. There are specific criteria in place to qualify for this, such as being unable to work for longer than 28 weeks.

Am I Eligible To Claim Compensation Through The CICA?

You can claim through the CICA if you meet the specific requirements outlined by the CICA, which are:

  • You were injured during a violent crime (such as sexual assault)
  • The crime occurred in Wales, England, Scotland or another qualifying place (such as a boat registered in one of the countries mentioned)
  • A report of the incident was made to the police
  • You have begun the claim within the time limit (we explain this further in the next section)

How Do I Receive CICA Compensation?

You need to give evidence and meet the legal time limit in order to receive CICA compensation. Firstly, you need to prove that:

  • You meet the CICA residency requirements
  • The crime was reported to the police (you can provide a police reference number for this)
  • You were injured during the incident (your medical information should outline this)

It is also important that you meet the appropriate time limit for your case. This generally means that sexual abuse compensation claims need to be made within 2 years of the date on which the crime happened. However, if you can prove that exceptional circumstances prevented you from starting your claim within this period, you could still be able to proceed. 

If you suffered a violent crime as a child, the following time limits apply:

  • If you were below the age of 18 at the time of the incident and a police report was made, you can make a claim within 2 years after your 18th birthday
  • If you were below the age of 18 at the time of the incident and no police report was made, you can make a claim within 2 years after reporting the crime to the police. You will also need evidence of the exceptional circumstances, such as historic abuse, that stopped you from making a report earlier.

Making A Criminal Injuries Compensation Claim On A No Win No Fee Basis
