CICA Sexual Abuse Compensation For Psychological Impacts
CICA sexual abuse compensation for psychological impacts is valued using the same fixed tariff. Claimants will need to be in receipt of a clinical prognosis and/or diagnosis from a psychiatrist or clinical psychologist to support their claim. The CICSA Scheme includes specific awards which deal individually with mental illness as well as those which take physical or psychological injuries into account in the same award. This can include examples such as Post-Traumatic Stress Disorder (PTSD) due to sexual abuse.

What If There Are More Than Three Injuries?
The CICA only awards compensation for up to 3 injuries from the main tariff. However, the main tariff doesn’t apply to certain injuries.
Payments for pregnancy, sexually transmitted infections or the loss of a foetus sustained as a result of a sexual offence are not subject to the multiple injury formula (set out after the table) that applies to injuries from the main tariff. This table looks at examples of CICA payouts for injuries outside of the main tariff.

The CICA uses a multiple injuries formula to award compensation for up to 3 injuries. The most serious or highest valued injury is awarded the full tariff value. The multiple injuries formula then applies a reduction to the tariff value to subsequent injuries.

- The highest valued injury is awarded 100% of the tariff value.
- The second is awarded 30% of the tariff.
- The third is awarded 15% of the tariff.
This formula is applied whether injuries fall into the same category, or different ones. For example, a criminal injury claim involving physical harm and sexual health impacts may use this formula.
Please note, if there are more than 3 injuries from this main tariff, compensation only be awarded for those 3 with the highest value.

Yes, the CICA can compensate for special expenses arising directly from the abuse. Any special expenses included in your claim are separate to that included in the tariff and must not be freely available elsewhere. Special expenses help survivors of criminal injuries to meet essential costs incurred due to their assault or attack.

How The CICA Calculate Lost Earnings As A Result Of Sexual Abuse
The CICA calculates lost earnings as a result of sexual abuse using a fixed formula. This formula is based on Statutory Sick Pay. Awards are only made for lost earnings if the claimant is unable to work, or has a limited capacity to do so. Compensation for lost earnings exclude that incurred during the first 28 weeks, beginning on the first day of the 29th week.
Awards may be calculated by taking both past and future lost earnings into account. To do so, the rate of Statutory Sick Pay is multiplied by the number of weeks the claimant is unable to work. The formula accounts for that lost before both before and after the claim is decided.
To be awarded compensation for lost earnings, survivors must meet the eligibility criteria.
- They were in paid work at the time the abuse occurred.
- They were in regular paid work for 3 years prior to the abuse.
- There was a valid reason for them not working, such as being in education, if not in work.
