How Will The CICA Determine The Value Of A Claim?

The CICA will determine the value of a claim using a fixed tariff that accounts for the specific nature of the injury, its severity, and any financial losses you have incurred. When assessing your application, the CICA also factors in the impact on your mental health and whether you have suffered a disabling psychological injury as a result of the violent crime. This harm includes post-traumatic stress disorder (PTSD) and must be formally diagnosed, either by a psychiatrist or a clinical psychologist.

What Will The CICA Pay Out For Multiple Injuries?

The CICA will pay out for multiple injuries using a specific formula to calculate the compensation value for each injury. This approach means you would receive:

  • 100% of the tariff for the most serious injury
  • 30% of the tariff for the injury with the second-highest amount
  • 15% of the tariff for the injury with the third-highest amount 

This formula allows a maximum of 3 injuries to be considered. However, certain payments are exempt from this limit, meaning you would receive 100% of their value. This is possible in circumstances where a violent crime led to you becoming pregnant, losing a fetus, or contracting a sexually transmitted disease.

Will CICA Compensation Cover Loss Of Earnings?

CICA compensation can cover a loss of earnings that resulted from your criminal injuries, but specific eligibility criteria must be met. This means that you must have:

  • Been unable to undertake work
  • An established history of working or a good reason for not having such a history for 3 months prior to the event 
  • Been employed at the time of the violent crime
  • Lost income for longer than 28 full weeks (starting from the date of harm)

Can The CICA Compensate For Special Expenses?

Yes, the CICA can compensate for special expenses if you have experienced financial losses as a direct result of your injuries. Common expenses that a criminal injury claim can cover include:

  • Replacing damaged physical aids, such as hearing aids and glasses
  • Purchasing mobility equipment, for example, wheelchairs or specially adapted vehicles
  • Installing stairlifts, wet rooms, or other structural modifications to support independence in the home
  • Paying for care to assist with food preparation or bodily functions
  • Fees for supervision if you pose a substantial risk of harm to others or yourself
  • Costs related to administering your personal affairs if you have been left mentally incapacitated

All special expenses must be reasonable and necessary. The CICA also requires that you show they were not freely available from the NHS or an alternative source.

What Will The CICA Pay Out After A Fatality Caused By Crime?

After a fatality caused by crime, the CICA will typically pay out to help qualifying close relatives manage funeral costs, bereavement, and the loss of financial or physical dependency. To qualify, you will generally need to be:

  • A civil partner or spouse of the deceased who lived in a household with them (this can also apply to a former spouse who was financially dependent upon the person)
  • A parent or child of the deceased
  • A partner of the deceased who lived with them for at least 2 years before the fatality
  • A partner of the deceased who was unable to live with them due to infirmity or ill health

Awards For Financial Dependency

If you relied on your loved one’s income, you may be eligible for a financial dependency award if they were in paid work. However, if they were not in paid work, the CICA will require evidence of caregiving responsibilities or another ‘good reason’ for their unemployment. The award is calculated based on the period of dependence using the Statutory Sick Pay weekly rate in place at the time of death, which is £123.25 for the 2026/27 period.

Dependency payments are generally made in a lump sum. If more than one family member qualifies, the weekly entitlement is divided equally among all claimants.

Compensation For Physical Dependency

If you are a qualifying relative who physically depended on the deceased, you may also be eligible for compensation for the loss of a main carer. They must have provided most of your day-to-day care needs, including:

  • Bathing and other personal hygiene practices
  • Preparation of food and eating
  • Safeguarding 
  • Continence management
  • Minor treatments or taking medicine

Funeral Payments

You may receive a flat-rate funeral payment of £2,500 under a CICA compensation payout. If this does not cover basic costs, a further £2,500 payment may be made. However, the CICA will only pay this additional allowance if there is evidence of the expenses and that these were reasonable. This can account for the cost of the ceremony, headstone, flowers, and memorials.

Compensation For Children And Dependents

A child may claim for the loss of parental services if they were below the age of 18 when the death occurred. Special consideration is given to acknowledge the impact a parent’s death can have, such as the loss of:

  • Affection and love
  • Treats
  • Supervision and care
  • Being taken to activities and events 

The CICA will calculate the payment as a lump sum of £2,000 for each full year from the date of death up to the child’s 18th birthday. Proportional payments will be made for part years.
